3HAVENS COTTAGES SHORT TERM RENTAL AGREEMENT

1.0 Use

Rental includes exclusive use of the specified 3Havens Cottage for the rental period for recreational purposes only. No commercial, illegal, or other activity shall be carried on at the property. The Renters may not sublet or assign this rental agreement. Renters shall abide with all local by-laws and ensure that adjacent property owners or renters shall have the quiet enjoyment of their properties.

2.0 Occupancy

The maximum number of occupants using the cottage premises shall not exceed the total number of 8 in Rocky Haven, 7 in Cozy Haven and 5 in Toddy Haven.

3.0 Pets (very strict – no exceptions)

No pets are allowed on the property belonging to our guests or their visitors. Family members have severe allergies that pose health risks. If you show up with animals, you will need to find a kennel off property to care for them or you relinquish your right to rent from us and will not be entitled to any refunds due to lost bookings.

4.0 Smoking

No smoking is allowed in the cottage. If smoking outside, renters are to place all butts in ash can ONLY next to fire pits. No butts to be thrown in yard as this is a fire hazard.

5.0 Parking

Parking for a maximum of two cars is available. The Renters are to park their vehicle(s) where sign indicates. For oversized vehicles, there is space at the top of the looped driveway. For Toddy Haven guests an all wheel drive vehicle is needed for ground level access. Non all wheel drives, other parking is available.

6.0 Equipment Provided

Each cottage comes equipped with: fridge, stove, microwave, TV, internet, DVD player, coffee maker, toaster, dishes, glasses, cutlery, pots/pans, and general kitchenware, picnic table, lawn chairs, a propane grill, metal fire pit with cover, vacuum cleaner and cleaning equipment. Two kayaks and a canoe with life vests and paddles as well as two fishing poles with basic supplies. Rocky Haven includes a dishwasher, and a washer and dryer in the master suite. Cozy and Toddy Haven have free access to an onsite laundry facility from 3:30pm-11:59pm each day. It is equipped with two full sized washers and dryers (4 units).

7.0 Internet/TV

Each cottage is equipped with wireless internet and TV service through the Roku device. There is no phone at the cottage. Renters are advised to bring a cell phone in case of an emergency.

8.0 Water

We have a drilled well with a great new water filter system under the kitchen sink.

9.0 Plumbing

The cottages are served by a well and septic system. Renters agree to abide by the following rules to ensure the proper functioning of the plumbing systems: No paper waste to be placed in the toilets except toilet paper. No food scraps to be washed down the sink - animal fats to be left to harden and placed in garbage.

10.0 Heating, Cooling and Electricity

The cottages are heated by propane furnaces. The floors on the lower levels are heated by radiant heat. In Cozy Haven the upstairs has radiators. Nothing should be left in front of, or on top of the radiators due to fire hazard. In Rocky the upstairs has a heat pump.

Toddy Haven has a large capacity heat pump with an air conditioning mode for cooling down the entire unit. Rocky Haven has a high capacity window air conditioning unit in the living room and a heat pump for cooling in the master suite. Cozy Haven has 3 window air conditioners: 1 in the living room and 1 in each bedroom.

Each cottage has a light switch that controls the beachside lighting (one switch is also beachside).  Rocky's switch is at the outside corner of the cottage near the electrical entrance coming down the stairs from the driveway. Toddy's switch is on the outside back corner of the house. Cozy's is on the left side of the inside stairs.

*Please note, radiant heat in the floor downstairs takes a while to heat the space. Once at the desired level, the space will be comfortable and nice on the feet. It also takes a bit of time to cool down when lowering the heating temperature since the entire cement slab has to dissipate that heat. There are fans available to keep the rooms cooler. Renters agree to abide by the following rules in order to act responsibly in conserving propane: No doors/windows are to be left open in cool weather while the heating is on. Lights are to be turned off when retiring for the night or leaving the cottage

11.0 Fire pit

Each cottage is equipped with one wood burning metal outside fire pit. Renters agree to abide by the following rules to ensure fire safety:

Only untreated firewood is to be burned in the fire pit

Renters provide their own firewood (may be purchased along Rt. 1). There is dried kindling on the property and it may be used too. Fires are not to be left unattended or in the care of children. A metal bucket of water is to be kept on hand when the fire pit is in use. Fires are to be extinguished upon retiring for the night. Renters are to abide by all municipal by-laws and bans (if any) regarding outdoor fires and will be responsible for any fines incurred. Call the Orland town office for more details.

NO FIREWORKS ARE PERMITTED ON THE PROPERTY DUE TO INSURANCE COVERAGE.

12.0 Propane Grill

The Renters agree to abide by the following rules for use of their Grill:

The Grill is NOT to be moved from its location due to fire safety requirements

The Grill lid must open before lighting

The Grill has a self-lighting mechanism.

Only propane gas is to be used for cooking on the Grill: no other materials are to be added

The Grill is not to be left unattended when lit. The gas is to be turned off at the tank after use.

The Grill is to be cleaned and the grease pan emptied after cooking in order to deter animals (racoons and bears). (Rocky has a griddle and it must not be used with any metal utensils due to the ceramic coating. It must be cleaned using the supples provided at the grill.)

The plastic cover should not be replaced until the BBQ is completely cool.

13.0 Bedding and Linens

Each cottage is equipped with one King size bed in the master bedroom. There are two Double/twin size bunkbeds in Rocky and one Double/twin size bunkbed and a pullout Queen sofa at Cozy. Toddy come with a queen bed and twin trundle in the second bedroom. Each bed is supplied with its own mattress cover, pillows, sheets, and comforter. Additional blankets can be found in either the Master bedroom dresser , bedroom closets, under the bunk beds or in Cozy Haven n the upper hallway closet.

14.0 Liability and Risk

The owners have endeavored to ensure all information respecting the cottages are current and accurate and each cottage is suitable for recreational use. The owners do not warrant or guarantee the quality of the cottages as this is basically a subjective opinion. The renters acknowledge that the use of the property is entirely at the renter’s own risk. The renters shall indemnify and hold harmless the owners against and from any and all expenses, costs, damages, suits, actions or liabilities arising from any and all loss of or damage to personal property, injury, personal condition or death resulting from the use of the rental property, grounds, and lake/pond use. Renters swim and use the kayaks, canoes or boats at own risk. The owner’s property insurance covers the dwelling and the owner’s contents. It is the renter’s responsibility to insure against any unforeseen damage or loss of the renters own possessions. The renters shall give the owners prompt written notice of any accident, unsafe or dangerous condition, other defect to the cottage, surrounding property, buildings, equipment, or other possessions belonging to the owners.

15.0 Safety and Damage Prevention (Important)

The renters are responsible for all damages caused by any member of their party, or their visitors or guests, even to the extent that these damages may exceed the Security Deposit provided. The renters shall be liable for any damage done by reason of water being left running from taps in the cottage or improper use of appliances, equipment provided, or fire pit.

Renters agree to use common sense to prevent accidents and damage, including but not limited to:

Nothing is to be placed on top off or in front of the stove or grill or near a lit fire

No fires to be left unattended or in the care of children

Fire screens and methods of extinguishing fires to be kept on hand at all times

No materials other than untreated wood/kindling to be used in the fire pit

Fires are to be extinguished upon retiring for the night or leaving the cottage

Outdoor fires are not to be lit during fire bans – _renters will be responsible for any fines incurred

The Grill must NOT be moved due to fire restrictions

Grill to be cleaned and grease pan emptied to deter animals

Grill lid must be open before lighting and gas must be turned off after use

Window screens/screen doors/outside doors are to be kept closed to prevent wildlife/insect intrusion

No running water is to be left unattended

No pot or kettle is to be left unattended on a hot stove or in a hot oven

All wet clothing is to be removed at the door and boots are to be placed on the boot tray provided

16.0 Smoke Alarms/CO Detectors

These items are installed as required by the fire code.

Renters are not to disable or remove batteries from the smoke alarms or carbon monoxide detectors

17.0 Power Failure Procedures

In the event of a power failure, the rental units are equipped with automatic backup generators for your convenience.

18.0 Owners Access

The Renter shall be allowed an access code to the cottages during the renter’s occupancy only

19.0 Severability

If any provisions of this agreement are invalid, such provisions shall be considered separable and the remaining provisions shall remain in full force and effect.

20. Arrival Procedures

Renters may arrive after 3.00pm on the possession date agreed to in the Rental Agreement.

Upon arriving at the cottage, Renters are to familiarize themselves with the cottage and its amenities. If anything is missing, damaged or not working, or if the cottage has not been left in an appropriate state of cleanliness, they are to contact the Owners immediately.

21. Departure Procedures

Renters are to leave no later than 10.00am on the date agreed to in the Rental Agreement.

Renters agree to keep the cottage and all furniture, fixtures, fittings, and effects in/or about the cottage in the same state of repair and condition in which they found them upon arrival. Refer to the following DEPARTURE CHECKLIST (posted in cottage too). Compliance with that list insures complete return of the security deposit.

22. Departure Checklist

In order to receive a full security deposit refund, renters shall complete all the tasks spelled out on the Departure Checklist before leaving the cottage:

All dishes, glasses, cutlery, pots and utensils thoroughly cleaned and returned to kitchen cabinets/drawers

Fridge, freezer and cupboards to be emptied of all foodstuffs

All bedding and sheets are to be placed in the pillow cases and left in the bedroom

The grill cleaned and grease pan emptied. Gas turned off and cover replaced on cool BBQ.

All lights turned off and heat pump turned OFF.

Kayaks and Canoe locked. Keys must be returned to the hook left of frig.

Before locking up and departing, please leave curtains open, put all the trash in plastic garbage bags and place them in the green dumpster at the top of the driveway.

No cottage furniture, equipment, appliances, or other possessions belonging to the Owners shall be removed from the cottage.

23. Security Deposit

This security deposit will be returned within 14 days following the end of the rental period. If any charges or damages have been incurred (including pay per view, lost keys) these costs will be deducted from the Security Deposit.

24. Dock System

There is a dock available for use by Rocky, Toddy and Cozy Haven guests. Please do not jump or dive off the dock. There are many rocks beneath the surface of the water and bodily injury may occur. If you choose to swim or jump off the dock, you do so at your own risk. Boats can use the dock for loading and unloading passengers and supplies. However, the dock is not sturdy enough for boats to be tied up for prolonged periods of time (especially in windy or wavy conditions). In such cases, you may either anchor the boat or use the mooring provided if it is free.

25.0 Acceptance

By booking online through any of our online partners, renters agree to all things in this rental agreement.
